As a HCA you will need to prove you are free of active Tuberculosis either through a negative TB skin test or through chest X-ray. TB clearance must be provided to your employer with in 7 days of the hire date or 90 day prior to the date of hire. HCAs are required to provide ongoing TB clearance at least once every 2 years. State and Federal Requirements
This new system replaced the CBC system, and the current transfer functionality and ability to view rosters in the Licensing Information System has been relocated to Guardian. Guardian provides new self-service options to applicants, registrants, agencies and Regional Offices without intervention by the Care Provider Management Bureau . The term "agencies" is inclusive of all licensed facilities, Foster Family Agencies, Home Care Organizations and TrustLine agencies. Before registration approval, an individual must complete a criminal background check process administered by the California Department of Social Services. An exemption is a CDSS-authorized written document that "exempts" the individual from the requirement of having a criminal record clearance. If an individual is convicted of a non-exemptible crime, that individual cannot work in any licensed facility or for a health care organization, and an individual’s application will be denied, or the license revoked based on the conviction. The CDSS also has the authority and responsibility to investigate arrests to determine if the underlying conduct is substantiated and therefore presents a risk to the health and safety of clients who are in care. A criminal record exemption is a CDSS-authorized written document that "exempts" the individual from the requirement of having a criminal record clearance. The Home Care Services Bureau is responsible for licensing Home Care Organizations including processing applications, receiving and responding to complaints and conducting unannounced visits to ensure compliance.
To file a complaint regarding a Home Care Organization, contact the Home Care Services Bureau through telephone, mail, or email . You will be required to pay a fee of $35.00 to register; payment can be made by debit or credit card. If applicable, await Home Care Organization confirmation.
You then will receive an email sending over a temporary password. To become an HCA you must meet the requirements of AB 1217. It is your responsibility as a caregiver to make sure you have met the regulations of AB 1217 and are placed on the Home Care Aide registry. An individual can search the status of a registered Home Care Aide or Home Care Aide applicant by entering the Home Care Aide’s first name, last name, and Personnel identification number (PER ID / HCA ID).

HCSB is also responsible for the Home Care Aide application process and maintenance of the Home Care Aide Registry. California law established the Home Care Services Consumer Protection Act which, as of January 2016, requires Home Care Organizations to be licensed and creates a public online registry for Home Care Aides who have been background checked. This law is intended to promote consumer protection for elderly and disabled individuals who hire private aides to come into their homes and provide assistance with activities of daily living. Before an individual can obtain a community care license, or provide services, work or reside in a community care facility, he/she must receive a criminal record clearance from the Care Provider Management Bureau .
An individual convicted of any crime other than minor traffic violations is disqualified unless the California Department of Social Services grants an exemption from the clearance requirement. All convictions other than minor traffic violations require an exemption, and this includes misdemeanors, felonies and convictions that occurred a long time ago. For all registrations and renewals, the Department is required to provide the name and telephone numbers of Registered HCAs who do not opt-out of this requirement to labor organizations when the labor organization asks for the information. This means that if you do not opt-out of this requirement, your full name and any telephone numbers on file with the Department may be released to a labor organization. They must pass a criminal background check that involves being fingerprinted, and they are required to pay a registration fee.
The law states that the labor organization can only use your information for employee organizing, representation, and assistance activities and it also states that the labor organization cannot disclose your information to any other party. However, the Department has no authority over labor organizations or control over what they do with the information. California's caregiver registry was created as part of the Assembly Bill Consumer Protection Act requiring senior home care agency's to be licensed by the state and all professional caregivers working in homes to meet minimum requirements. The Home Care Aide Registry provides individuals with the ability to check the status of a Home Care Aide who is listed on the Home Care Aide Registry.
This system is to be used only by Community Care Licensing and TrustLine applicants for CDSS criminal background check purposes. Pressing "OK" and the subsequent use of this system is an agreement to comply with the authorized uses of the system. In accordance with PIN CCLD, a Licensee User Access Form has been sent to all licensee mailing addresses, requesting information to create a unique Guardian user account. The form is to be completed under penalty of perjury that all information provided is true and correct. The Licensee User Access form will ensure only authorized users will have the appropriate access to Guardian.
